Terms of Service

These Terms of Service (“Terms”) govern access to and use of the KiBand service (“Service”) together with the applicable signed order form. The Service is supplied by the legal entity identified as the supplier in that order form and operating the KiBand brand from Morocco (“KiBand”, “we”). No paid contract is formed until the order identifies the supplier's complete legal details and is accepted by both parties.
1. The Service
KiBand provides a multi-tenant software-as-a-service platform for hospitality venues to manage guest digital wallets, points allocation, coupons, and NFC-based consumption at points of sale. Mobile terminals are provided as companion applications.
2. Accounts and access
- Customer is responsible for maintaining the confidentiality of its credentials and for all activity under its account.
- Customer is responsible for the roles and access it grants to its staff members.
- KiBand may suspend access if it reasonably believes the account is compromised or used in breach of these Terms, with prior notice when practicable.
3. Subscription and payment
- The commercial offer shown on our Pricing pageremains subject to qualification and the signed order form.
- The assisted founding pilot is 45 days at €750 excluding tax for one property and up to two service points. Hardware, travel and specific connectors are quoted separately.
- After the final review, the Customer may separately choose a €149 excluding-tax monthly subscription per property or a €1,490 excluding-tax annual subscription per property.
- A €375 excluding-tax conversion credit is deducted from the first annual invoice when the annual option is confirmed within 15 days of the final review.
- Taxes, currency, payment terms, renewal and termination conditions are stated in the signed order. No automatic renewal applies unless that order expressly provides for it.
4. Assisted pilot
The pilot scope, success criteria, data sources, owners and timeline are agreed before launch. Conversion is never automatic: the Customer may continue, extend or stop after the final review. Any free technical demonstration environment is separate from the paid pilot and creates no subscription commitment.
5. Customer data and ownership
- Customer retains all rights in its data. KiBand is granted a limited license to process Customer data solely to provide the Service.
- Data processing is governed by our Privacy Policy and the Data Processing Agreement available on request.
- Customer is responsible for obtaining the legal basis to import, store, and process guest data (including consent where required).
- Export, return, retention and deletion follow the signed order form and Data Processing Agreement, subject to mandatory legal retention. No specific period is promised unless it is approved and stated in those documents.
6. Acceptable use
Customer shall not, and shall not permit its users to:
- use the Service to process data unlawfully or in breach of third-party rights;
- reverse engineer, decompile, or attempt to derive the source code of the Service, except to the extent permitted by law;
- circumvent access controls, resell the Service, or use it to build a competing product;
- upload malware, attempt denial-of-service attacks, or interfere with the Service or other Customers.
7. Service level and availability
Service hours, support targets, maintenance notice and any availability commitment apply only when they are expressly stated in a signed order form or service-level schedule. Operational targets used during a pilot are not warranties unless approved and incorporated into those documents. Offline operation of compatible Android terminals can reduce the impact of connectivity outages at the property.
8. Integrations with third-party systems
The Service can integrate with third-party property management and point-of-sale systems chosen by the Customer (e.g. eZee Absolute, ipos247). KiBand is not responsible for the availability, correctness, or pricing of those third-party systems. Each Customer is responsible for its own contractual relationship with those providers.
9. Intellectual property
KiBand retains all rights in the Service, including software, trademarks, documentation, and design assets. No rights are granted except those expressly described in these Terms.
10. Warranties and disclaimers
Any service warranty, remedy or exclusion must be expressly stated in the signed order form or an incorporated schedule. Mandatory rights under applicable law remain unaffected.
11. Liability
Allocation of liability, any cap, excluded losses and applicable exceptions are governed by the signed order form and mandatory law. This public page does not by itself create or imply a liability cap.
12. Term and termination
- The term, notice periods, cure rights and termination conditions are stated in the signed order form. No paid renewal is automatic unless expressly accepted there.
- KiBand may suspend only the access reasonably necessary to address a material security risk, unlawful use or serious interference with the Service, with notice when reasonably practicable.
- Exit, export and deletion follow the signed order form and Data Processing Agreement.
13. Modifications
Updates that materially change an agreed price, scope, liability or data-processing commitment do not amend a signed order form without the written acceptance required by that order. Other updates may be notified for future use of the Service.
14. Governing law
Governing law, dispute resolution and competent jurisdiction are those stated in the signed order form, subject to mandatory applicable law. No jurisdiction is implied by this public page alone.
