Terms of Service
Effective date: 21 April 2026
These Terms of Service (“Terms”) govern access to and use of the KiBand service (“Service”) provided by KiBand SAS, Casablanca, Morocco (“KiBand”, “we”). By creating an account or subscribing, you (“Customer”) agree to these Terms.
1. The Service
KiBand provides a multi-tenant software-as-a-service platform for hospitality venues to manage guest digital wallets, points allocation, coupons, and NFC-based consumption at points of sale. Mobile terminals are provided as companion applications.
2. Accounts and access
- Customer is responsible for maintaining the confidentiality of its credentials and for all activity under its account.
- Customer is responsible for the roles and access it grants to its staff members.
- KiBand may suspend access if it reasonably believes the account is compromised or used in breach of these Terms, with prior notice when practicable.
3. Subscription and payment
- Fees are described on our Pricing page and billed in advance, monthly or annually, per property.
- Annual plans are pre-paid for twelve months. Mid-term cancellations are not refunded unless required by law.
- Monthly plans renew automatically and can be cancelled effective the next billing cycle.
- Prices are quoted excluding applicable taxes, which are added at invoice time.
- Late payment may trigger suspension after a 15-day written notice.
4. Trial
A free 14-day trial may be offered. No payment is required during the trial. At the end of the trial, the Customer must subscribe to continue using the Service; otherwise, the account is placed in read-only mode for 30 days and then archived.
5. Customer data and ownership
- Customer retains all rights in its data. KiBand is granted a limited license to process Customer data solely to provide the Service.
- Data processing is governed by our Privacy Policy and the Data Processing Agreement available on request.
- Customer is responsible for obtaining the legal basis to import, store, and process guest data (including consent where required).
- Upon termination, Customer can export its data for 30 days, after which the data is deleted from active systems within 90 days and from backups within 12 months.
6. Acceptable use
Customer shall not, and shall not permit its users to:
- use the Service to process data unlawfully or in breach of third-party rights;
- reverse engineer, decompile, or attempt to derive the source code of the Service, except to the extent permitted by law;
- circumvent access controls, resell the Service, or use it to build a competing product;
- upload malware, attempt denial-of-service attacks, or interfere with the Service or other Customers.
7. Service level and availability
We target 99.5% monthly uptime for the control panel and the device APIs, excluding scheduled maintenance and events beyond our reasonable control. Offline operation of the Android terminals is a first-class feature of the Service and mitigates connectivity outages at the property.
8. Integrations with third-party systems
The Service can integrate with third-party property management and point-of-sale systems chosen by the Customer (e.g. eZee Absolute, ipos247). KiBand is not responsible for the availability, correctness, or pricing of those third-party systems. Each Customer is responsible for its own contractual relationship with those providers.
9. Intellectual property
KiBand retains all rights in the Service, including software, trademarks, documentation, and design assets. No rights are granted except those expressly described in these Terms.
10. Warranties and disclaimers
The Service is provided “as is”. To the maximum extent permitted by law, KiBand disclaims all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Liability
To the maximum extent permitted by law, KiBand's aggregate liability under these Terms shall not exceed the fees paid by the Customer to KiBand during the twelve months preceding the event giving rise to the claim. KiBand is not liable for indirect, consequential, or punitive damages, including lost profits or loss of data, except in cases of gross negligence or willful misconduct.
12. Term and termination
- These Terms take effect when Customer first accesses the Service and continue until terminated.
- Either party may terminate for cause with 30 days' written notice if the other party materially breaches these Terms and fails to cure within the notice period.
- KiBand may terminate immediately in cases of severe abuse, fraud, or insolvency.
13. Modifications
We may update these Terms. Material changes will be notified to Customers at least 30 days before taking effect. Continued use of the Service after the effective date constitutes acceptance.
14. Governing law
These Terms are governed by Moroccan law. Any dispute shall be submitted to the competent courts of Casablanca, Morocco, except where mandatory local consumer law provides otherwise.
